These terms and conditions apply to all relationships between G168 Co., Ltd. (hereinafter "the Company") and GAY SAIMIN PICTURES members (hereinafter "Members") regarding the internet communication service (hereinafter "GAY SAIMIN PICTURES") provided by the Company as the planner and operator.
Article 1 (Scope and Changes to Terms)
Various regulations announced by the Company through GAY SAIMIN PICTURES from time to time shall constitute a part of these terms and conditions.
The Company may change these terms and conditions and other regulations, including changes to fee regulations, at any time without obtaining the consent of Members by displaying such changes on GAY SAIMIN PICTURES.
Article 2 (Members)
Members are those who, upon agreeing to these terms and conditions, apply for the use of GAY SAIMIN PICTURES according to the procedures prescribed by the Company, are approved for membership by the Company's review, and are registered as users of GAY SAIMIN PICTURES.
Article 3 (Membership Qualifications and Approval)
Persons under the age of 18, or high school students regardless of age, may not become members.
The Company will review applications for the use of GAY SAIMIN PICTURES and, if membership and registration are approved, will issue an identification number (hereinafter "ID").
Please note that the Company may not approve an application if the applicant falls under any of the following:
・If it is found that the membership registration application contains false information, errors, or omissions.
・If it is found that the applicant has previously been expelled due to a violation of these terms and conditions.
・If the applicant has previously delayed the performance of payment obligations for GAY SAIMIN PICTURES usage fees or refused payment.
・If the use of the credit card or payment account designated by the applicant has been suspended by a credit card company or financial institution.
・If the applicant is a minor, a quasi-incompetent person, or an incompetent person, and has not obtained the consent of a legal representative or guardian when applying for membership.
・If the applicant possesses multiple login accounts and has used the Company's services fraudulently.
・If the applicant has shared, disclosed, or provided videos, images, or audio from this site to third parties without authorization.
・If the Company otherwise determines the applicant to be unsuitable as a member.
Even after an ID has been issued, if it is found that a member falls under any of the preceding items, the Company may suspend the member's status or cancel the approval.
Fees incurred through the use of GAY SAIMIN PICTURES prior to the cancellation of approval as stated in the previous paragraph shall be borne by the Member and shall be paid without delay using the method specified by the Company.
Article 4 (Password Management and Responsibility)
Members may not transfer, pledge, or allow a third party to use their own ID and password.
Members shall bear full responsibility for the management and use of their own ID and password and shall pay all debts related to their use.
Even if a Member suffers damages due to the use of their ID or password by a third party, the Company shall not be held responsible, regardless of whether there is an attributable reason.
Article 5 (Notification of Changes)
If there are any changes to the information notified to the Company, the Member shall promptly notify the Company via email.
If a Member neglects to provide notice of changes and this causes damages to the Company, the Member shall bear the liability for compensation.
However, requests for damages shall be made after consultation between the Company and the Member.
Furthermore, the Company shall not be held responsible even if a Member suffers a disadvantage due to the failure to notify of changes.
Article 6 (Member Personal Information)
The Company shall not disclose or leak a Member's personal information to third parties, except when necessary for the operation of GAY SAIMIN PICTURES.
Article 7 (Provided Services)
The services and program contents of GAY SAIMIN PICTURES shall be those available at that time as provided by the Company.
The Company may change (including abolition or modification) the content of the provided services or programs at any time without the consent of Members by displaying such changes on GAY SAIMIN PICTURES.
The Company may temporarily interrupt or stop GAY SAIMIN PICTURES services without prior notice due to regular or emergency maintenance, disasters, natural catastrophes, legal measures, or other circumstances.
The Company may terminate GAY SAIMIN PICTURES at its own discretion.
Notice of such termination will be announced through GAY SAIMIN PICTURES or other means provided by the Company.
The Company shall not be held responsible for any damages suffered by a Member or a third party due to delays, interruptions, or cessation of GAY SAIMIN PICTURES services for any reason.
Article 8 (Prohibition of Misappropriation and Protection of Copyright)
Members may not, by any means, misappropriate, edit, falsify, or provide/use for themselves or third parties—regardless of whether it is for business purposes—all or part of the services provided by GAY SAIMIN PICTURES or data related to the services provided by GAY SAIMIN PICTURES.
Article 9 (Precautions for Information Registration)
Members may not register information or content that falls under the following items on GAY SAIMIN PICTURES:
・Content that violates public order, morals, or laws.
・Content that leads to criminal acts.
・Content that infringes on the copyrights, trade secrets, publicity rights, or other property rights, honor, or privacy rights of other members or third parties.
・Content that causes disadvantage to, or slanders/defames other members or third parties.
・Content that obstructs the smooth operation of GAY SAIMIN PICTURES.
If a Member causes damage to other members or third parties through the use of GAY SAIMIN PICTURES, said Member shall resolve the matter at their own responsibility and expense, and shall not cause any damage to the Company.
If a Member violates this article and causes damage to the Company, the Company may claim compensation for such damages from the Member.
However, requests for damages shall be made after consultation between the Company and the Member.
Article 10 (Deletion of Inappropriate Registered Information)
If the Company determines that the content, such as text registered on GAY SAIMIN PICTURES, falls under or risks falling under the preceding article, the Company may delete such content or information without notifying the Member.
Article 11 (Usage Fees, etc.)
Regarding usage fees and payment methods, etc., the Member shall comply with the fee regulations separately stipulated by the Company and displayed on the Company's site, in addition to these terms and conditions.
Furthermore, bank transfer fees and other expenses shall be borne entirely by the Member.
Article 12 (Fee Payment, etc.)
The payment methods for usage fees are as follows:
・Payment by Credit Card
Credit card payments are processed on our behalf by the credit card payment system of Telecom Credit Co., Ltd.
Payment shall be made based on the terms of the credit card company using a credit card issued by a credit company approved by the Company.
・Payment by Transfer to a Designated Bank Account
Please pay into the bank account designated by the Company.
Please note that any fees incurred during the transfer will be borne by the Member.
In the event of a dispute between the Member and a financial institution, it shall be resolved between the parties involved, and the Company shall not be held responsible in any way.
Please note that under no circumstances will fees once paid be refunded.
Article 13 (Withdrawal Procedure)
If a Member wishes to withdraw from membership, they shall notify the Company via email. If there are any debts to the Company, the debt must be settled and the remaining balance paid immediately. There are no fees for withdrawal. The time from the withdrawal application to the final withdrawal will be a maximum of two weeks.
The Company will not refund any fees already paid by the Member. Furthermore, all remaining points will be forfeited.
Cancellations after the withdrawal procedure has been completed are not possible.
Article 14 (Expulsion, etc.)
[Section 1]
If the Company determines that a member falls under any of the following items, the Company may suspend the use of the ID or strip the member of their membership status and expel them without any prior warning or notice:
・If the member made false declarations at the time of registration.
・If the member declares that they will not comply with the membership terms.
・If the member has engaged in unauthorized use or falsification of entered information.
・If the member has improperly used their ID or password.
・If the member has violated any of these membership terms.
・If the member has used GAY SAIMIN PICTURES for illegal activities.
・If the member has shared, disclosed, or provided videos, images, or audio from this site to third parties without authorization.
・If the member has not purchased points for one month after registration completion.
・If the Company otherwise determines the member to be unsuitable as a member.
When a member is expelled, they lose the benefit of time and must immediately pay in full all fees and charges incurred up to the time of expulsion.
The Company will not refund any fees already paid by an expelled member.
[Section 2]
If the Company suffers damages due to the actions of a member falling under Section 1, the Company may claim compensation for such damages from the member, regardless of the suspension of ID usage or expulsion.
Article 15 (Jurisdiction)
For any disputes arising between the Company and a Member, the district court having jurisdiction over the location of the Company shall be the exclusive agreed court of first instance.
Article 16 (Returns of Digital Products)
When providing digital distribution services using an internet-connected server, the Company will not accept returns of products provided as digital data such as videos and images (hereinafter "Digital Products") for any reason, unless otherwise required by law.
